1. Introduction
Havenway Lettings Ltd (“we”, “our”, “us”) provides residential lettings and property management services across the United Kingdom. By accessing our website or using our services, you agree to these Terms & Conditions. If you do not agree, please discontinue use immediately.
2. Eligibility
Our services are intended for:
- Individuals aged 18 or over
- Landlords legally entitled to let properties in the UK
- Tenants seeking residential accommodation
3. Services We Provide
We act as a third-party agent between landlords and tenants. Services include:
- Property marketing on UK portals (Rightmove, OnTheMarket, SpareRoom, Zoopla where applicable)
- Tenant sourcing and referencing
- Preparation of tenancy agreements
- Rent collection (if instructed)
- Full property management
We charge commission only to landlords, unless otherwise agreed and documented.
4. Fees & Payments
• All fees will be communicated clearly before service engagement.
• Payment terms and commission structures will be outlined in your service agreement.
• Late payments may incur additional charges.
5. Tenancy Agreements
• All tenancy agreements comply with UK housing legislation.
• Havenway Lettings Ltd is not liable for disputes between tenants and landlords arising from breach of contract.
• We are not responsible for changes made directly between landlords and tenants outside our written agreements.
6. Landlord Responsibilities
Landlords must:
- Ensure the property meets legal health & safety requirements (EPC, Gas Safety, EICR, smoke alarms)
- Provide accurate property details
- Comply with Right to Rent laws
- Pay all agreed agency fees on time
7. Tenant Responsibilities
Tenants must:
- Provide truthful information during referencing
- Maintain the property in reasonable condition
- Pay rent on time as per tenancy agreement
- Report maintenance issues promptly
8. Liability
We are not liable for:
- Indirect or consequential losses
- Errors arising from incorrect information provided by landlords or tenants
- Damage caused by contractors or third parties
- Temporary unavailability of the website
Our liability is limited to the maximum extent permitted by UK law.
9. Termination
Either party may terminate our services by giving the appropriate notice specified in the service agreement. Ongoing fees may still apply depending on contract terms.
10. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
